Yankee fan <NOBR style="FONT-FAMILY: Verdana, Arial, Helvetica, sans-serif; COLOR: darkgreen; FONT-SIZE: 100%; FONT-WEIGHT: normal" id=itxt_nobr_1_0>Jay-Z </NOBR> has filed a $5 million suit against David Ortiz, accusing the Boston Red Sox slugger of getting more than an empire state of mind after visiting the rap mogul’s swanky Manhattan nightclub, 40/40.

Court papers filed Thursday in Manhattan Federal Court accuse Ortiz of visiting the Jay-Z-owned nightspot on two occasions then opening up a copycat club in his native Dominican Republic, the New York Daily <NOBR style="FONT-FAMILY: Verdana, Arial, Helvetica, sans-serif; COLOR: darkgreen; FONT-SIZE: 100%; FONT-WEIGHT: normal" id=itxt_nobr_2_0>News </NOBR> reported.

"David Ortiz was at the club at least twice, and certainly knew of it," Jay-Z's lawyer, Peter Raymond told the News.

As proof, the filings reportedly include photos of the designated hitter partying at Jay-Z’s club on W. 25th Street.

Ortiz’s representatives did not return calls for comment by the News or The Associated Press.

Besides the New York club, Jay-Z boasts other 40/40-branded hotspots in Atlantic City, Las Vegas, Chicago, Tokyo and Macau.

The name is a reference to when a baseball player hits 40 home runs and steals 40 bases in a single season.

yeah this seems like a bonehead move... I mean, I could see it if he or his partners didn't know about Jay's club, but what are the chances?

I mean the club is in the DR


i'm not positive, but I assume some guy in France can't start a company called Microsoft. so I'm assuming there are international laws about this. also, Ortiz living and paying taxes in the US might have something to do with it. these are just guesses based on logic though, maybe someone with more knowledge will chime in.

Reason #23423 why I hate the sports media. Why in the hell did they have to put in the part that Jay-Z is a Yanks fan? The Big Copy just swiped a name of a legitimate business which basically has plans to go global and their trying to assume its because of the rivalry. Pshhh.

The 40/40 club in Vegas didn't even last a year before it went tits up. Now the Emeril sportsbook stadium.
