Anyone know if a public urination shows up on a backround check/record?

Hey guys i was at the beach over the 4th holiday and got busted on a public urination ticket. Very stupid of me I know :ohno:. Anyway I tried to call up and pay the fine but am required to report to court in August. I don't mind paying a fine and it being done with but I am a bit concerned about it showing up on my record and/or on a back round check (currently unemployed, applying to jobs). Anyone from New Jersey that might be able to help? Or anyone that may know your input is greatly appreciated. Thanks

You talk to the prosecutor and seek a "continuance for dismissal." This is the legal equivalent of, "Oops! Sorry, won't happen again." You will have to pay "attorney's fees" usually about equal to whatever fine you would get if you were convicted. The plus is that this won't go onto your record if you don't do it again in 3 years. The minus is that, if you do do it again you can't get a continuance for dismissal on that action AND this will go on your record, too.

I dont know how the law reads in New Jersey, but if it is like Iowa you better hope there were no kids around. I dont know how many feet it has to be, but in Iowa in there are children around within so many feet of where one gets a public urination ticket, not only do they get that ticket, but they have to register as a sex offender for a short period of time.. I would definitely get a lawyer if that is a possibility at all. If not, it is a simple misdemeanor, plead guilty and move on. No biggy. Or if you are getting older & dont plan on getting in any more trouble use your defered judgement. That is an oops, I'm guilty but Im not type of deal and it will not go on your record. Everybody gets 1 to use in your lifetime.. Again, I'm not sure if that is an Iowa law, or a US law.

Thanks for the response, no kids were around, it was just a stupid mistake after leaving the bar. I'm just trying to figure out what my best option is. As I said previously, I dont mind paying the fine but dont want it on my record. So if I dont get a lawyer plead guilty, I will get a fine will that go on my record as well? Or if I get a lawyer and do what billhill mentioned, (continuance for dismissal) will I be paying a lawyer and that now keeps my record clean?

If you have the cash pay a few hundred bucks and have a lawyer make it dissapear.

Yea that was my thought initially until I called.......The maximum fine will be $1250. Again this was on 4th of July weekend so I think the fines are doubled or tripled.

Go talk to a good lawyer.They should be able to get it dismissed for you, for probably less than what it would cost you in court fees and a fine.

Wow didn't see that the fine is 1250,yea they should definitely be able to get it dismissed for wayyyyyyyyyy less than that.

Yea, my jaw dropped when the lady on the other end of the phone said maximum of 1250. I expected a couple hundred bucks and avoid going to court, but apparently thats not the case. Thank you for the response

What I do know is if you pay the fine, you plead guilty or were found guilty & then yes it will show on your record.. If you get the "deferred judgment" or the charge dismissed it will not show. Hope all this helps.. The one thing you dont want to have happen is you pay the lawyer, and still have to pay the fine.. But lawyers get paid for a reason, so he shouldn't have a problem getting it dismissed I wouldn't think. Let us know how it ends up.

I Got busted peeing outside a bar once at about 2 in the the morning. I totally walked to secluded area and peed in some bushes no one was around. Some cops were on the roof of the bar staking it out for some reason. Came into the bar 5 mins later and busted me. I denied it was me of course. They let me off with a warning after embarrasing me in front of some girls, and checking for warrants.
So whats the update here?

Is it county court or like a city, township, or village?? Like mayors court? If it's county court it will likely show up on your record if convicted (and probably even if it's dismissed). If it's mayors court or a district city court it usually wont show up on a background check. At least thats the way it is here in Ohio.

They can not triple the fine because its fourth of july.

The law probably says something stupid like up to $1250 and 30 days in jail. In reality, anyone who goes to court with a lawyer will get something stupid like public nuissance or something and pay $100-200. The court doesn't want to spend money on a trial (especially if requesting a jury).

It's just like DUIs. Many states are like up to $10,000 and 1 year in jail, yet we all know people get probation and alcohol classes or a weekend at government paid camp.

This happened to me as a teenager (before 18) in quebec.

In quebec it was simply a ticket like a speeding ticket that needed to be paid.

no court unless you wanted to plead not guilty.
