Is it illegal to buy used IPODS full of songs off EBAY

I have noticed that there are people on EBAY selling there used IPODs, and in the ads they state they are full of songs.

Is this legal?

Is this the same thing as someone selling there CD collection on EBAY?

I saw one ad where someone was selling an IPOD with a 160G HD with over 40K SONGS.

This is over $40,000 worth of music for a couple of hundred songs.

I have to think this is some kind of grey area at least.

Might be a Grey area... I would look at Completed sales and see if any of these were taken down at one point or another.

If not, I think you might be covered.

"creating" the collection and then selling it for profit is very likely a violation of copyright laws on the music therein.

Buying it is not likely a crime in itself.

It is perfectly legal no law states if you sale a used Ipod you must delete the contents. If you sale a used computer is Microsoft going to take you to court for pirating Windows software? If you buy it you can sale it ONE(1) time is what makes it legal. You go into Pawn Shops you can buy used CD's all the time so it must be legal you think.

Except the music on them was in the vast majority of cases not acquired legally.

I would imagine it is legal. As long as you advertise you are selling the IPOD and not the songs on it. As long as you are just giving the songs along with it you are fine. Read an article in a business magazine a few months ago about how in China it is illegal to resell any stuff from apple, the IPAD specifically. So to get around this they sell IPAD CASES on EBAY for like $1000 and each case you get a free IPAD. Think there are places where they can't sell alcohol because of legal reasons so they sell the glass for like $20 and the drinks are free.
