Costa Rica Hit And Run Suspect Attempted Fleeing To Canada, Picked Up In The U.S.

The suspect who ran over and killing one worker on the Virilla or "platina" bridge of the autopista General Cañas didn't make it enter the United States when he was surprised by the US Customs and Border officials who detained him on his arrival at Hartsfield Jackson airport in Atlanta.

The identity of the man was only by his last name, Wellington and is a Canadian national.

The news of the accident that occurred late Wednesday night was withheld, made public Thursday afternoon, as authorities followed up leads and video images from cameras on the autopista of the hit and run vehicle, locating it in a parking lot of the Ramada Herradura hotel.

The vehicle had been a rental and once the man's identity had been obtained, a quick check of immigration records indicated the man had taken an early morning flight on Delta Airlines, headed for Atlanta.

In coordination with US authorities, Costa Rica's Organismo de Investigación Judicial (OIJ) alerted Atlanta customs, where he man was taken into custody and returned, in the company of US customs agents, to Costa Rica on a Delta flight 413 Thursday night.

It appears that the man, who had been in Costa Rica for three months, tried to get to Canada but since there are no early morning direct flights to Canada, opted for a stop over in the United States. Delta, as well as American Airlines and US Airways have early morning flights from San José.

The accident occurred on Wednesday night, when a speeding car - some say going over 120 km/h - going from Alajuela to San José, hit two workers on the reconstruction of the bridge.

One of the workers, Omar Lepiz , died on the scene while the other is in hospital with injuries.

Due the accident Tránsito officials decided, for the safety of the workers, to close down the autopista from the Juan Pablo II bridge to the Castella between 10pm and 5am, detouring traffic through Heredia.

60 to 70 mph is not all that fast normally, but on that road, near construction... It doesn't say whether he had been drinking or not. But I'm guessing that may have played into his panic.

You know the guy had to be sweating the options. Canada probably wouldn't extradite, but would he last in CR until the afternoon flight? And could he catch a flight out of the states before it all caught up to him? Being Canadian in the states, he didn't have the right to challenge the request.

Maybe it isn't as simple as it appears, but it don't matter now, 'cause if there's anything this guy won't be getting, it's a fair trial...

you are right, it doesn't matter, based on his actions it doesn't look as he wanted a trial to start with.......

but of course his lawyer is already challenging the statement that his g/f made (claiming that it is 'his wife'....since they have lived together for over 6 months) so don't be so sure his trial won't be fair, there are plenty of technicisms that may get this guy out

as far as Canada extraditing or not, that would be an interesting question, I don't know how many countries have rules like we have in CR about not extraditing its own citizens. I doubt he was technically 'extradited' from the US btw, since they probably never admitted him to the US to start with.

It wouldn't be considered extradition from the US, as he was turned away at the port of entry as an 'undesirable'. Just a simple request from CR authorities to the US authorities gets this done. Canada does not have a formal extradition treaty with CR, but there are diplomatic relations that exist that enable extradition. It would be difficult to say exactly what would happen to him had he been caught in Canada after fleeing. He's being charged with something in Costa Rica that is 'homicide' and can face up to 30 years in jail, while in Canada I think it would be a much lesser offence that would likely carry at the very most a few years in jail as a first offence assuming the prosecutor can prove that alcohol was involved (which we don't know at this time). More than likely, he wouldn't even do time in Canada for this, and would likely plead guilty and lose his drivers license for 5 or 10 years and do some community service and probation. Canadian courts may insist that he be tried on a lesser offence if they are agreeing to extradite him. The whole process could take many years.

I disagree with the "probably wouldnt do time" , wouldnt this be involuntary manslaughter ? There is a person dead due to reckless behavior and also fleed from the scene, I doubt you can get away with community service after something like that.

The alcohol part we can forget about, if he was drunk ..........they didnt get either blood test or breathalyzer on time.........so thats out.

One thing is for sure, the outcome here will also take many years....

I bet he'd rather spend "X" amount of years in Jail back in Canada than do it in "La Reforma" in Costa Rica. Se jodio ese mae.

I think that if he made it back to Canada, he would be 'home free'. Being a traffic offense, it wouldn't be considered a serious enough in Canada to warrant extradition, especially with no formal treaty in place. If it was a regular murder, that would be another story. He obviously didn't think his exit plan through too much. I'm glad they caught him though, what a douchebag.

BTW... so much for hoping they will reconsider the idea of the new traffic cameras. This case is going to be made an example of how they improve public safety.

Interesting points. But as a foreigner, think about it. Say you're driving back from the beach and you accidentally hit someone on the road. Well, now you've got some unpleasant choices to make.

Stopping means, Drunk or sober, you'll be arrested. . You are not innocent until guilty here, they'll toss in you jail until they figure it out. And they're not known for figuring out things quickly...

I haven't seen, and probably won't see the video. So I don't know how it went down. But it is not uncommon for people here to be where they shouldn't regarding the roads. All those yellow hearts/halos represent a jay-walking mentality.

It very well could be this guy was smashed and didn't slow down. The construction guy didn't see him in time to get out of the way, and bam! Pinche Gringo kills and flees... But I'm of the belief this story finds the truth somewhere in the middle.

I can imagine him as his Delta flight leaves the ground breathing a huge sigh of relief... Hahahaha... Poor Bastard...

Imagine this, I am a foreigner in the US and do the same, they have death penalty (I know I know, not for this type of thing) and they have also screwed up a few times with it......too late to fix it, there are also lots of cases of people convicted under testimony of 'witnesseses' who later on were found to be wrong (think 20 -30 years), I am a latino and hit someone in Arizona...those guys in AZ are not very happy these days about latinos even if I am not an 'illegal alien'.

Defending myself, even if I am RIGHT may cost a FORTUNE (unless I choose to go with public defendants who may not be the best) , I also know that once I get to CR they cant get me out. Should I flee?

About the video, I havent seen it, dont even know if its been shown on tv....perhaps it will prove the point that the worker was not where he should have been?

In my view the most important thing is, SUPPOSEDLY they drive very civilized up north....yet this guy comes down and before you can say "pura vida" he has turned into one of 'us/tico drivers', at best, he knew VERY WELL that you can't speed in construction areas (seen the sign a hundred times in US roads, FINES DOUBLED IN CONSTRUCTION AREA and there is another one that I dont recall right now about injuring a worker)

Incidents like this, happen every single day, except that this time it was a darn gringo (canuck, etc doesnt matter, you are all 'gringos' to us )

If you kill a pedestrian on the freeway, your not automatically at fault, and you will not automatically get arrested. It's not legal for pedestrian to cross the freeway like they do here. I know someone (foreigner) who unfortunately and allegedly killed someone crossing the freeway, and they were not detained.

It's possible this guy was reckless or drunk. It's also possible that the construction workers were simply as reckless and careless as those pedestrians climbing over the median barriers every day. One trip or fall over those barriers and they are in the middle of oncoming traffic that has no chance of stopping in time.

Unfortunately this country doesn't give a shit about road or traffic safety.

I dont think anyone is saying that its correct to do that

HM is saying that the guy may not trust our legal system

and lets not forget that they almost linched Alejandro Rueda (the tv mejenga guy) when he ran over someone and it turned out it was a glicemia issue and thats why he appeared drunk

at some point it was even LEGAL to leave the scene of a hit and run, as staying was considered self-incrimination (and I am not making this up, it was the recommendation of lawyers years ago!!!!)

Went a little ways down the road, stopped the car and tried to collect himself. The options aren't pretty... He's fucked either way...

It's time to go... He looks up flights, strongly considers the Air Canada 2:55pm flight to Toronto. But realizes someone may have read the plates, only a matter of time before they put it together. He's dealt with I.C.E. and CR banks enough to think maybe the O.I.J. is just as fucked up and may take a while to connect the dots. But better leave just in case.

There are 5 U.S. bound flights before the Delta flight to Atlanta in the morning. So I imagine he tried to buy something online and needed the 2 hour window. May have had something to do with a Canada connection.

That hour or so he waited to bored that flight to Atlanta was probably the longest hour of his life. Maybe the weight of it all was hitting him as he sobered up. You know he was waiting for cops to walk into the boarding area with his picture. The moment those wheels left the ground, he breathed a huge sigh, probably even praying. As he flew to an uncertain future, he knew he'd never go back to Costa Rica...

For a country that doesn't function that well normally, the O.I.J. handled this shit lightening fast. Maybe they should be in charge of I.C.E.... Just sayin'...
