Today get a call from collection company saying I owe $352 for internet service that I had in 08 on the other side of the country. I said ok , but I haven't lived at that location since 07 and I remember paying my bill then cancelling my service as my lease was up. Now 3 years later i get this call , I try to explain and she says the account is still in my name and has been active since 07 (So they didnt cancel) and someone has been paying it in my name. The last payment was made in June 2010. Im not sure what I can do to prove it wasnt me and they made the mistake. I havent even been there in almost 2 years , i havent lived at that address since 07. Just strange and of course they dont believe me. How the hell do I prove it wasnt me ? I had no idea this was going on and its been 3 years. Just crazy

I hate bill collectors. I went the doctor to be advised on getting a vasectomy had to pay 175 out of pocket, paid it on the spot. A year later I get a call from a collector saying I never paid it, the bitch called me at work and threatened me with a lawsuit and legal fees if I didn't pay it. I had the proof that I paid it but wasn't good enough. Looking at houses right now and the last thing I need is a law suit that would cost me more than the damn bill, so I paid it again. The bitch still reported it on my credit.

When I went to the loan people I explained to her what had happened and she advised me to never pay in the future because the it's accepting guilt on your credit report. Don't pay it is my advice and request that it be removed from your credit. The next time they call, tell them not to call you anymore, they can try to sue you but they'd have to do it where you live now, and you'd obviously be able to prove that you didn't live there, and that it wasn't you.

Screw them. They aren't going to sue you because it cost so much, and such a little amount is owed. Since they are a company, they can't sue you in small claims court, so to start a regular lawsuit, it's going to cost a minimum of around $300 in CA. to start the suit, and then another $325 an hour for a lawyer. Tell them to stick it where the sun don't shine.

man its a catch 22 for u, i was in that biz for a while in college.....u have to send the collection agency new proof of residence in anohter state with a (depending of if they want u to, a proof of sale of your old place) then they mite still try to scare u into paying, chances are its on your credit asa collection agency account (check ur credit to see if they reported it) also, it will stay there for 7 years....

also u woudl have to get one of those credit repair guys to take it of your credit

i wouldnt pay...and if you settle, and if u do settle make sure u get in writing thats u r even with them and they are going to report it to the credit agencies

either way i woudl nt pay especially if its been 3 years...the only way it will matter on your credit is if u go buy a new assest and if u do the new lender will require u to make good on that acct...i would wait till then if n e thing, and it goes away after 7 years of initial reporting.....just weigh your optiosn i guess

but dont pay...

no need for lawyers or n e of that...first see if its on your credit...these companies bought the debt for llike 4%...they not taking u to court for 300 bux, it cost em more to take u there...

I have a $2000 towing bill on my credit report that won't go away. It was from a car I sold 3 years prior and somehow the DMV had me listed on the title somewhere even though I turned in my release of liability. No matter how many times I direct them to the rightful owner, they still call.

never pay or you're guilty, i'm going through something similar about a rental car (they stole cds out of the car so I said f-u) I threatened them with harassment and contacted my lawyer and he threaten to sue them with theft and harassment and have not heard from them since lol....I hope I didn't just mush myself.

Find a good Lawyer that won't charge you a stupid amount. He will file a demand letter - they will ignore. Then he will file a Temporary Restraining Order (not to be confused with one your thinking of) It's a court document that basically means he went down and filed the paperwork to sue their ass. They will delete the whole collection trade line within 72 hours if the Lawyer knows what he's doing.

It is very simple:

By certified mail with a return receipt, send them:

I do not believe ____ debt is mine.

If you believe it is mine, please validate it for me as required by the FDCPA. Please send to me proof the debt is mine (contract bearing my signature or something similar), a description of all charges, payments, interest, and fees arriving at the debt total, and proof that your company has the legal right to collect this debt.

Do not contact me again until you have done the above and only contact me via mail in the future.

From that point forward, every time they contact you without properly validating and every time they contact you by phone they have broken federal law punishable by $1000 per act + actual damages.

Once they break the law a few times, threaten to sue them if they contact you again, report the debt to any credit reporting agency, or do not remove it within 30 days.

They will go away after a few letters and when they think they are going to be sued.

Also NEVER pay a collection agency without a written statement from them that they will delete/not report the debt to the credit reporting agencies. If you pay you are admitting guilt.

Well I got one for you when I was in college had a credit card got wrote off and now received a letter from a debt collection firm suing me for the amount owed plus court cost. I thought the credit card company had wrote it off.

Well , i called them today and gave them my side of the story "Again" , called the company which I originally had the hook up (Telus) and they verified that the last payment made was July 2010 for 200$. I asked them to look into how the payment was made , Also I am going to my local police station tomorrow to file a claim of Identity theft , which this is. I just hope there is some trail of who paid the bill , they obviously knew the account number and name to pay it. This is just a huge pain in the ass, I mailed equifax canada and ordered my credit report ( Which is free if you mail ) But i am assuming its on there since they have my Lincense number , Social Insurance number on the bill. I do admit i had the hook up , but I paid it and canceled the service as my lease was up. I Dont have the bill it was over 3 years ago, and of course the company says they cant find anything on me canceling. Whatever Ive done everything I can at this point. Sucks that its going against an otherwise decent credit rating. I will fix it , it couldnt have hurt it to much I bought a house and truck lol , just surprised it took this long to contact me.

I let it sit on there until just about a month ago because i wasn't gonna pay that ridiculous amount. So. i told him about it and he said give me a week and ill have it off of there. He told me what he planned to do and did it. The last thing a collection company wants to do is spend time and money in court on a collection they bought for pennies on the dollar. If the lawyer is good and knows how to get shit done they will just want it to go away.
