So I was just recently married a couple of months ago. 2 weeks ago my wife put her name change on our bank account with my last name. Apparently someone with the same name as my wife's new name owes the state of Minnesota a ton of money, so the State of Minnesota put a Levy on all of our accounts today. Of course there is nothing we can do until monday cause their office is closed until monday. My question is, is it legal for them to put a levy on my account based on name alone or do they have to match SS#'s. My last name is very uncommon and I'm guessing you just cant go around putting levy's on someones account without proof. Do I have a potential lawsuit here?

I'm sure Baccy is best to answer this..... But i do believe that they should do a Bank Search by name, then through SS#

The girl with the tremendous debt shares the same last name as me, my wife has no debt we've been together for close to ten years now before marrying. The tax debt is actually from this other girls business, which i happened to locate on Facebook, I told her I would include her business in the lawsuit if she didn't call them and clear it up.

Your argument is compelling sir, but I'm a government employee and I'll be off next week as part of the generous benefits package my fellow residents voted in under Gov Tim Pawlenty.

Please call back sometime in late April, but not during my lunch break

You should have gotten to know her better before marrying her.

Sounds like you'll be paying this off for a long time.

Update. So it's been resolved. The person that has the same name as my wife had a bank account at the same bank as us and they didn't bother match up the SS#'s they just levied us. Now the Bitch with the same name is threatening to sue me cause I mentioned her name and not paying her taxes on my Facebook account, What a fucking loser. Minnesota apparently didn't even bother to give US Bank a SS# to go off on. I sent Minnesota an email saying that I was hiring an attorney and seeking damages, that got their attention and they fixed it pretty fast.
