curious if you get fired from you job if you can collect unemployment...and how long it takes etc

anyone have any previous experience

i live in MA (no i wasnt fired but im getting fed up at my current place and am wondering if im enough of an asshole and they decide to can me if i could collect)

any info appreciated

There is no yes / no answer. Why were you fired? How many warnings? How big is the company. Will they take time to fight it.

Yes. When you get fired or laid off is when it's easiest to collect unemployment , as opposed to quitting where it is much harder. It usually takes several months , so hopefully you'll be able to find something sooner.

You will have your first check ( a two week check ) within a month. My answers are based on Pennsylvania laws.

Not sure if it is the same in all states but YES you can, as long as they deem your misconduct was not malicious and intentional (i.e. you get yourself fired on purpose).

You can file online in 20 minutes, then it takes about a week for the claim to process. There is a waiting week where you don't get paid, which runs while the processing takes place, then you start getting paid. I get $776 every other week after taxes. I got fired for poor attendance. Had to do a phone interview where they deemed my misconduct was not on purpose (not sure how this is possible...)

Depends on your state, go read MA's website. The amount of misinformation out there on unemployment is greater than anything I've ever seen or heard.

Don't piss off a previous employer that you are looking to collect unenjoyment from. In MA they have to verify a form once you open your claim and, being fired will disqualify you. Whether you can collect or not will depend greatly on the information previous employers provide. Ask for a voluntary lay off if work is scarce or if they are already letting people go, throw yourself on the sword, someone else might even appreciate it.

At minimum you will have to go through an appeals process and you will probably still be denied if you were fired and a previous employer says you were fired for "being enough of an asshole".

I hope this helps in your decision but only you know your employer.

ive never been fired before and ive never collected before. ive never called in sick in 10years there. they are giving me shit about weekends (i dont have a problem working 1 a month) but if they are going to start taking advantage of me (i just worked b2b weekends) im just gonna start calling in sick. this will cause major headaches for my boss b/c its only 2 of us and both are expected to be there when scheduled....

im willing to test her patience etc by just calling in sick if they start scheduling me regularly

An employer changing your work conditions/hours may be a different story. Any Workplace Lawyers around??? You should be able to speak with an attorney for free(albeit briefly) on that one. I'm sure there's much precedence on similar situations and in MA it is easier to collect than most states. My $.02 was more towards avoiding pissing off your employer because they have obligations to the state, but you may have more grounds than I was thinking. I would think that you could ask for a layoff because of the changing shifts and they may have to give it to you.

explain your dissatisfaction to your boss.
remind your boss of your attendance record.
ask your boss for an explanation of why you are working weekends.
if it looks like you'll need to start working more weekends, you can either ask for more money that would make it worth your while, or if they can't come up with the money or you just "won't" work weekends you should continue to work while you seek another job.

don't quit or "force" them to fire you so you can collect unemployment while you look for new work.

It all depends on circumstances - you'll just have to try and see. There will be an adjuster who gets facts from you and the employer (if the employer fights your claim). The adjuster makes a decision, which can then be challenged by either side, which would require a hearing to determine who's in the right.

This all comes from my experience with my time on unemployment while living in MA two years ago.

I live in Connecticut and have seen at least a dozen or so people get fired for stealing and or sexual harrassment among other things and they are still able to collect unemployment..Its fucking unreal..

I am from MA and this happened to me 5 years ago while working for an insurance company. If it is a firing the company can elect to fight it. Most do not as they pay into the unemployment tax anyways so it doesnt matter to them....maybe they will throw you a bone...my old company never appealed

i got fired from a job years ago, it was a hassle but i got it. i wasn't licensed so i shouldn't have technically been doing the work by myself. i messed up and got fired. i had to submit formal letters and state my case then had a hearing, and i won. took about close to 2 months, but after i won i got all the back pay up to the day i was fired, and then collected for another 6 weeks or so until i got a new job.

and i lost a job to excessive absenteeism , but i had doctors notes and bills from where i towed my car and repair shop bills. tried to call it "misconduct", but i won that one too.

if you file for unemployment, the gov. agency will check in with your former employer on why you were fired. usually, when you are fired, the company will not be happy with you and HR (or individual owner) will not give you a pleasant review favoring or qualifying for collecting unemployment.

Nowadays I don't know why anyone would be trying to get fired from their job, be thankful for the one you have. But IMO if I was that person I would work my ass off at the establishment, and make it well known to the managers that your gunning for their job. In the long run you'll be building your resume by working your ass off, and those managers that you intimidate with your work ethic will do anything they can to prevent you from taking their job. Including being deceiving to try and get your removed from the workplace. Employers do not need a reason to fire you, as long as isn't due to race, sex, disabilities, etc.
