Let's say you were mislead by your new landlord of 1.5 months, who knowingly moved you into an apartment with shared access next to/or under a 40 plus year old mentally ill guy that still lives with is mother, as well as falls in love with every woman that has lived in the house you are currently renting, a dude that has had the cops called on him on various occassions for being annoying and loud , laughs like a lunatic at all hours of the night, and says disturbing shit to your wife all the time? Said landlord quickly you in, and greedily taking your deposit without so much as a warning about the guys problems.

Would you fight for your deposit? What are the rights of the renter in this situation?

from a practical stand point any landlord (specially this kind) knows the law and how long it takes for anything to be solved, in other words, it will take you time and money to get your deposit back as you will probably have to sue him I imagine

so the question is: do you have the time to waste pursuing this issue ? PLUS remember you are going to need proof of all these things you are saying, not just your word

The previous tenants had multiple issues with the guy upstairs atleast in one of which the cops we're called and Im 99% certain he is the reason they bailed on the place since he was in love with the other guy's wife and probably wanted to adopt her kids too. I guess my only proof would be if the cops filed a report or not. I dont really want to sue, but i would like to come with some sort of gentleman's agreement in which he accepts some sort of responsibilty for personally putting my family in a pontentially dangerous situation without warning us about the guy.

I'm not exagerating when i say the guy is really not right in the head and he is only a ladder's climb away from chopping our head's off. He even explained to my wife at one point that he has a mental issue that makes him want to hurt himself and other people, but he is too smart to let it consume/control him.

Move on, forget the deposit.

You can whine all you like to him, but he won't give you anything and there is nothing you can do. A gringo suing a tico landlord over the deposit? Heck, most tico's can't get their deposit back from a landlord.

Best thing to do is use the deposit as the last month's rent. He can't evict you fast enough, so no matter how pissed he is about it, he has little recourse.

sometimes I wonder if its all not a scam and he doesnt kick the guy out because its the perfect racket: Deposit + 1'st Month's rent and on to the next sucker.

Yeah I'd love to stay an extra month or two for free if it wasnt for the guy upstairs that wants to make a belt out of our nipples.

agreed, i feel for the guy. It's going to be an awkward move, I'm hoping he isnt there or his chainsaw is out of gas.
