NANUET, N.Y. - A 290-pound New York man is steaming mad at the White Castle fast-food chain, which he claims repeatedly broke promises to make the booths in his local eatery bigger.
Martin Kessman, 64, filed a lawsuit against the fast-food giant last week in Manhattan federal court, claiming that the uncomfortable booths violate the civil rights of fat people.
Kessman's lawsuit came more than two years after he complained to White Castle about the size of the booths at the Nanuet, N.Y., eatery and reportedly received a pledge that renovations would be carried out to cater for larger customers.
"They sent me specs and everything, about how the booths were going to be enlarged and made comfortable for people with a little more weight. So two and a half years went by, and nothing was done," he told the NY Post , adding that he has no problem finding a place to take a load off at other fast-food places and fits easily into airline seats.
The Americans with Disabilities Act is "applicable -- not only to me, but to pregnant women and to handicapped people," according to Kessman, who is suing for bigger chairs and unspecified damages. "I just want to sit down like a normal person."

Read this in the paper the other . Funny thing is While Castle Always had those tables... and this is the first time this was brought up ??

MYTH
: The ADA is rigid and requires businesses to spend lots of money to make their existing facilities accessible.
FACT: The ADA is based on common sense.
It recognizes that altering existing structures is more costly than
making new construction accessible.

The law _only_ requires that public accommodations
(e.g. stores, banks, hotels, and restaurants) remove architectural barriers in existing facilities when it is "readily achievable", i.e., it can be done "without much difficulty or expense."
Inexpensive, easy steps to take include ramping one step; installing a bathroom grab bar; lowering a paper towel dispenser; rearranging furniture; installing offset hinges to widen a doorway; or painting new lines to create an accessible parking space.


MYTH: The ADA protects people who are overweight.
FACT: Just being overweight is not enough.
Modifications in policies only must be made if they are _reasonable_
and do not fundamentally alter the nature of the program or service provided.

The Department has received only a handful of complaints about obesity.

Hell, it sounds like he's a good customer. I'd make the booth bigger and let him eat himself to death.

actually 290 lbs isn't that huge , not like 390 lbs...the guy could reasonably fit at many places. If you don't fit in the booth get it to go or something.
