Should I return this guys $500 deposit????

I'll make this quick and painless. I'm selling the last of my motorcycles and a gentleman from Georgia (I'm in NY) decides he wants the bike. He sends me a $500 deposit via pay pal and says he will come get it in a week. So I take the ad down (EBay and Craigslist) and tell him we have a deal. That was a month ago. I contact him today and he says maybe in 3 weeks. It appears he is going to end up backing out of the deal. Do you refund his deposit????? Nothing was ever said about the deposit being refundable.

You can return half of it if you are really generous but I wouldn't return any amount of the deposit. That is the whole purpose of a deposit.

You keep it.

If the guy needed to backout he should have told you, rather then keeping you hanging for a FULL mth.

One other option would be to tell him, it will take another 500 to hold the bike another 3 weeks.

I use Ebay a lot and also rent out my shore property myself. Once you accept the deposit you take the item off Ebay or in my case block the property for the week, at that point other people can not rent the property that week and I do not offer it that week because of the deposit. The deposit must be taken, if not only for the fact that you took the listing down and did not sell the item.....If the person backs out of the shore property, and I can rent the week, I will give the deposit back. Maybe tell the guy if you sell the motorcycle you will return his deposit?

I'd re-list the item. If you sell it, give him his money back. If you don't or it takes much longer or for a reduced price, tell him tough luck.
