Would it be legal to start a netflix type cd music monthly rental service?

charge 9.99 per month to rent up to 4 disk at a time.
people could get there disk and do you know what with them and send them back to get more and do you know what with the next 4.

I think this would be a huge money maker.

cheaper then DVDs.

there are many people like myself who feels the 256k audio quality from itunes sucks. My whole collection is burned lossless CDs.
the quality is much better then itunes.

I think millions of people would be interested in this service

And it would be a cheep business to start.

Interesting idea. My guess is you COULD do that.

I can't imagine there is a law that would stop you from renting me YOUR CD that you bought. WHat I do or don't do with it once rented is on me.

I wonder if pretty soon they will have it so that bought cd's can only be downloaded X amount of times?

Just met a a guy who runs a DJ service. He has around 4200 songs on file, all from CDs. He talked about for a small fee giving me access to ALL of them.

§ 109. Limitations on exclusive rights: Effect of transfer of particular copy or phonorecord42

(a) Notwithstanding the provisions of section 106(3), the owner of a particular copy or phonorecord lawfully made under this title, or any person authorized by such owner, is entitled, without the authority of the copyright owner, to sell or otherwise dispose of the possession of that copy or phonorecord. Notwithstanding the preceding sentence, copies or phonorecords of works subject to restored copyright under section 104A that are manufactured before the date of restoration of copyright or, with respect to reliance parties, before publication or service of notice under section 104A(e), may be sold or otherwise disposed of without the authorization of the owner of the restored copyright for purposes of direct or indirect commercial advantage only during the 12-month period beginning on —

(1) the date of the publication in the Federal Register of the notice of intent filed with the Copyright Office under section 104A(d)(2)(A), or

(2) the date of the receipt of actual notice served under section 104A(d)(2)(B), whichever occurs first.

(b)(1)(A) Notwithstanding the provisions of subsection (a), unless authorized by the owners of copyright in the sound recording or the owner of copyright in a computer program (including any tape, disk, or other medium embodying such program), and in the case of a sound recording in the musical works embodied therein, neither the owner of a particular phonorecord nor any person in possession of a particular copy of a computer program (including any tape, disk, or other medium embodying such program), may, for the purposes of direct or indirect commercial advantage, dispose of, or authorize the disposal of, the possession of that phonorecord or computer program (including any tape, disk, or other medium embodying such program) by rental, lease, or lending, or by any other act or practice in the nature of rental, lease, or lending. Nothing in the preceding sentence shall apply to the rental, lease, or lending of a phonorecord for nonprofit purposes by a nonprofit library or nonprofit educational institution. The transfer of possession of a lawfully made copy of a computer program by a nonprofit educational institution to another nonprofit educational institution or to faculty, staff, and students does not constitute rental, lease, or lending for direct or indirect commercial purposes under this subsection.

in otherwords...NO YOU CAN'T RENT YOUR CD's WITHOUT A SPECIAL LICENSE FROM THE ARTISTS/COMPANY THAT SOLD IT TO YOU.

Yea, anyone who is around 16 or older now(excluding old people) know how to download music and don't really mind the slight difference in audio quality. Why pay for music monthly when you get it free

Dont need to purchase from itunes, can get free from so many sources, but i just don't think the aduio quality argument is enough to justify paying more money. I have never encountered a person besides my dad to complain about music quality from digital music. Just don't think there is a big enough market

maybe the worst idea ever.. CDs will be obsolete in the near future and who the hell wants to rent music?

you get the CDs to convert it to lossless digital. I guess there are not many audiophiles in this forum. The sound quality from itunes or any other site that sells mp3s is bad.

You can download Flac files that are bigger than mp3 and sound better. CDs are on the way out.

yeah this is why renting cds makes no sense. like i said in 1994 it would have been great if logistically possible. now everyone has high speed internet and you can download pretty much anything

itunes sound quality is pretty bad, i think (i dont use itunes) they sell aac files which are pretty bad

You wouldn't even be able to cover half of your licensing fees and royalties if you did this plan....

As in, you'd go bust.
