My neighbor who is a good friend of mine is in a decent size pickle.
He texted an inapporpriate picture to a co-worker months ago and now shes claming sexual harrassment. She delelted the picture.
He asked me if I knew how it works.
I think you can go through your carrier and print out calls and text messages, even the police can get that info. His question is, can anyone see the actual picture he sent? he wrote nothing in the text, but he sent a picture. Anyone know if anyone can see the picture?

My brother told a dirty joke once at work to a friend, another worker over heard the joke, and he was fired for that. Texting a pic should be a no brainer. What an idiot, hopefully he works at McDonalds and not a high paying job which will be hard to find.

Just tell him to deny it.. Make her prove sexual harassment. If they trace the text and prove it so be it.

Almost positive if she deleted the picture then they won't be able to see that picture. They might can prove he sent here a multimedia message but that doesn't prove anything.

If I was him, I would deny, deny, deny.

Then again, I have never sent a picture like that.

The police CAN get the entire package. But the cost varies from carrier to carrier, in some cases its $500+ so it would depend on how serious they thought it was. I dont think that like her lawyer could obtain them for a civil suit but im not sure on that one.

Basically what ProPokerPlayer said. They'll most likely be able to retrieve it. Especially if it was fairly recently. Just like your computer, when you press delete, the item isn't automatically truly deleted from your computer. It goes into _____ space (my mind is blanking and can't think of the exact term). Only when a new item/program is created that takes up that once used space is the item truly deleted.

Very unlikely the police are gonna be involved here. Texting your penis to another adult is not likely illegal. If you continually harass someone it may be.

Your work is unlikely to be able to pull images that were deleted. They might be able to if they own the phone and pay the bill.

Just deny it and hope work believes you.

State laws could vary. Is there much difference in sending a pick of your penis to someone who didn't ask for it or just walking up to her and pulling down your pants?

Of course if the woman asked for it and is over 18 it would be different, but just sending the pic to someone you think is hot and didn't ask for it is different imo.

It take a warrant from a judge AND the carrier must agree to do it in a timely manner. It is going to be next to impossible AND very expensive for her to get the evidence from the carrier. Im not saying it is not possible but it will be EXTEREMLY unlikely for her to produce evidence is she already deleted it off the phone.
The other side of it is, is the employment rules for your state. I know NJ is a no reason state. An employer can fire an employee at anytime, as long as there is no underlying issue. But it all comes down to what the reason they put on the firing papers. A new boss can come in and fire someone for being gay as long as thats not the "reason" on file.
