Florida Man Charged With Felony for Allegedly Stealing $1 Cup of Soda From McDonald's

A Florida man was arrested and held on $6,500 bond after police in Collier County said he left a McDonald's without paying for a cup of soda valued at $1.


Mark Abaire, 52, had apparently asked staff at the Naples restaurant for a courtesy cup of water, but instead he allegedly filled the cup with soda from the soda fountain and sat outside of the restaurant, according to a story in the Naples Daily News which cited the police report of the Thursday incident.


Abaire allegedly refused to pay for the soda when he was asked to do so, refused to leave the restaurant and cursed at the manager, the Naples Daily News also reported.


Abaire, whose aliases include "Red" and "Clown," has a long list of prior arrests, according to records from the Collier County Sheriff's Department.


He was charged with petty theft, trespassing and disorderly intoxication after the Thursday arrest, and sent to Collier County jail. Petty theft is usually a misdemeanor, but because Abaire has previous convictions for theft, the charge was upgraded to a felony. The trespassing and disorderly intoxication charges are misdemeanors.


Abaire could face five years in prison if he is convicted of the felony.
Records indicate Abaire will return to court on May 14.

He also could have gotten away with it if he had just walked away from the place.

I read the article this morning...

He has a huge list of priors which led to a him being upgraded to a felony. The main problem was him refusing to leave the property. Guy looks like a maniac though...probably needs to be in jail before he hurts someone.

It takes a special breed of idiot to go to jail for I'm guessing 18 months for arguing a stolen watered down 1 dollar cup of coca-cola.
(if I was the judge, I'd tack on 9 more months of jail time for just looking like that)

There is a elderly couple where I have morning coffee at a local Hardee's restaurant that steal soda every morning. These people will use the cups from the day before and go out to their car and fill up a thermos for the day with the soda from inside the Hardee's. They will make two or three trips back and forth each morning in and out filling up their thermos. One morning the District Manager caught them in the act and let them off the hook. Now they only do it when the District Manager is not there.

It costs the taxpayer upward of $30,000.00 to $60,00.00 per year to incarcerate someone, so all you law and order types in this thread better open your wallets to teach "Clown" his lesson.

Not sure what a "law and order" type is. Does that make you a un-law and dis-order type?

Maybe we should spend $30,000 - $60,000 to rehabilitate him, since he's such a nice guy?

It makes me a realist. I don't want to spend that kind of money just because someone poured himself a Coke instead of a water. Why should society spend any money at all incarcerating a soda thief?

This. Exactly the same as the homeless man who confessed to a murder he supposedly was in on 25 years ago. I read that story on Yahoo as well...pretty sad when you need to commit crimes in order to get someone to take care of you.

People have been doing this for many years (especially kids), the smarter ones steal sprite or 7 up because it looks more like water in those see through plastic water cups. Seems the solution would be to charge 35 cents or something for a water cup or just not give them out without the customer making a purchase first.

So you steal something other than water? Are you really that cheap that you knowingly rob a business of their profits? I guess since you don't have a business of your own you don't understand, but being a low life piece of shit thief is the same whether it is for $1 or $100. I hope you don't set this kind of example for your kids.

I did the old ask for a water cup fill it up with dr. pepper trick when I was a teenager. Fast food soda is too damn expensive these days but my older self can live with the free water and lemon. I don't nearly drink soda pop all day long I did when I was a kid.

What is the true cost of syrup and CO2 these days? At the movies a soda is $5-$6, at the mini mart it costs $.79 any size and at a sit down or fast food joint the shit costs between $2-$3.
