I have a Question. Where I work I run shapers. They are machines that have a head with knives on them to put profiles in wood parts. Thers one part we run that you cannot use the feeder because the radius is too tight so I have to run them by hand on a shaper with no feeder or guards whatsoever. The supervisor knew I had to do it this way and never told me not to. I had done this for Quite a while with no problem until recently. I was running this particular part on this machine when the wood part I was running got sucked into the spinning head with my finger on top of it. I lst half my finger nail and the top part of the tip on my finger. They took me to the ER after it happened it looks like most of It will grow back but its a real pain now. I have to keep the end bandaged and its real tender with the chunk missing. I like working here it really is a nice job but in this world of suing was wondering If I may have a case to recover a settlement because of the machine with no guards.

You don't need to be an attorney to know you probably have a case.

The question then becomes: A) How easy would it be to get the same job elsewhere if they decide you're no longer needed, and B) How much goodwill you think you owe each other.

If they are fair with you for the most part and you have a good relationship with them, forget it.

If you fucking hate them and they've made your life a misery since you've been there, go to an attorney.

No idea how much you would get, which is yet another thing you need to consider.

You wouldn't be asking the question if it wasn't something you were thinking about, so how much do you think would be fair and reasonable? If you can come up with a figure you can then weigh that up against the importance of the job and the risk you'd be taking in upsetting them.

I think workers' comp laws shield the employers, although I'm not certain

if they were doing something illegal or unsafe, that probably changes things

The dude lost part of his finger. Sounds unsafe to me.

Whether the employer is at fault for the "unsafeness" is a different question.

You aren't gonna get much $ for the tip of a finger, for the big bucks you will need to make sure you keep it moist and dirty so that an infection sets in and you lose the whole finger. Heck who knows, maybe you might get lucky and lose the whole hand. That's where the REAL big bucks are at.

Like Boat said you're not gonna get life changing money out of this. Some of it might be part their fault and you not paying attention no disrespect intended accidents happen to everybody. And if you try and sue the company I'm sure you will get some money I would bet less than $50,000.00 so this isn't life changing, and you would be looking for a job because they would find a reason to let you go besides the point of you sueing them at that point the company looks at you as a liability instead of an asset to their company.

If I were you I would be thankful I didn't lose my whole finger, there's not enough money in the world worth losing limbs and body parts.

If they fired him he'd than have another larger lawsuit for wrongful termination. Retaliation for the original lawsuit.
