so my company owns and manages shopping centers...my job USED to consist of property management, construction, leasing to new stores, financing, etc...

now 50% of my time is devoted to defending lawsuits...

here is the scam....people come to my shopping centers with a friend (cameras in hand) and take a dive in the parking lot or in front of a store...they have the friend photo them on the floor writhing in agony...then they call 911 ask for an ambulance and get carted away.

THE SAME DAY a lawyer will show up and start measuring and taking pics of the area...a letter will arrive 3 days later announcing the party intends to file a suit for damages...

now here is the best part...98% of these cases will be paid a settelemt to not go to court regardless of the injuries... the average payout is about 20K...

when they go to trial watchout now....they will ask for upwards of 3 mil regardless of the injurry....out of 100 of these cases..about 98 have been settled and 2 dismissed before trial..

bottom line....take a fall at a shopping center, fake an injury, guaranteed money

I posted about this in another thread a week or so ago. Not only is this way out of hand what the people dont realize is there are "schools" specializing in training lawyers to do just this kind of "service". These "lawyers" dont know shit from shinola about any type of law but how to negotiate damage suits.
Think the government should crackdown on these schools?? Think again , without the Govt funding these schools would not even exsist....Thats correct, the govt is funding the education of these lawyers whos only skill is filing false damage claims. These pond scum have a clientele of sometimes 100 or more who are worthless POS's who on their behalf may have 30 -40 suits filed and pending all at the same time...
If the lawyer has 30 clients who each have 30 suits pending , thats 900 suits that 1 lawyer has going at any 1 time.....Open your phonebook and see how many lawyers are in ur town then multiply by 900....Then tell yourself govt is for the people by the people....Then go outside and bend over....

now I am really going to blow your mind with another scam to make money at shopping centers... I have had 2 of these in the last month

ADA compliance lawsuits.....so a lawyer will go to the old folks community and offer about 500 to anyone senior who is willing to put his name on a lawsuit...then they lawyer will file a suit claiming a shoppinf center is not compliant with ADA and the person has been discriminated against....Its not necessary for the person to have EVER visited the site either...

so now you have to agree to compliance with a whole laundry list of items and.....here is the scam...PAY ALL LEGAL FEES....

so now the propert owner has to spend an enormous amount on compliance and pay all legal costs (profit for the lawyer) or risk going to court and having old shriveled up mr smith testify about how he couldnt use the bathroom

No....ADA is governed by both the state and Federal Govt....

As far as the fake slip and falls....Ya you can try but unlike an indoor mall we dont have cameras....So all you need is a willing party and a slightly corrupt Dr and you are in business

sure...the thing is most times it will get settled before I am ever involved....so get yourself about 15k after taxes and lets ride a parlay into the sunset

Only if it goes to court....they can claim anything before that....its all about risk...in Palm Beach County for example we have very liberal judges....the Insurance Co is not going to risk letting these cases go to trial and lose. Its just easier and safer to pay off...

This is nothing New. Slip and Falls have been a money maker for people for years..
But in NY, most are settled for $5K-$10K just for them to go away.

Supermarkets are the biggest for Slip and falls.
