A mother who says Walmart employees intentionally humiliated her after wrongfully ripping up two of her $100 bills while believing they were fake is taking legal action against the store.

In her recently filed complaint, Julia Garcia is seeking no more than $74,900 in damages after detained for four hours before customers in San Antonio, Texas who were told she had tried to use fake money.

It was in the early hours of December 18, 2010 while doing some Christmas shopping for her children that Ms Garcia claims she presented the first $100 bill as payment before it was taken with suspicion from her.

She says that the bill wasn't actually tested by a counterfeit detection pen until after it was ripped, though that pen's result was either misread or ignored by the cashier.

According to her complaint: 'The cashier inspected the $100 bill, turned to another cashier and had a brief discussion, and returned to her register telling Plaintiff that her money was "fake."

'The cashier proceeded to rip the $100 bill in half without performing any counterfeit detection tests. The metallic strip in the $100 bill was clearly visible.'

After marking the bill with the detection pen, revealing a yellowish colour across it, Ms Garcia said she explained to the cashier of that colour meaning it was legitimate, having previously worked in retail herself.
The employee proceeded to call a manager over who identified himself as Russell. At this time Ms Garcia said she took out a second $100 bill, which according to her, was immediately taken and ripped up as well by the man.


Detained at the front of the store while told the police had been called, Ms Garcia claims that adding to her humiliation, the employees told curious customers in passing that she was busted trying to use fake money.

After two hours at the front, police arrived around 4.15am and proceeded to inspect the bills in question.

Following a series of tests the first responding officer, identified as Officer Edwards, returned to Ms Garcia telling her that what the Walmart employee and manager had done was a 'terrible mistake.’

'He then approached the manager, who appeared upset by what he was told by Officer Edwards,' according to the complaint.

‘After speaking with Officer Edwards, Manager Russell approached Plaintiff and sarcastically stated that the police officers said the money was not counterfeit, though he disagreed.

‘At this time, he attempted to hand Plaintiff the two torn $100 bills he had misappropriated from her. When Plaintiff objected to receiving torn bills, Officer Edwards instructed Manager Russell to replace the bills he had wrongfully taken and destroyed.'

Ms Garcia, who said she was escorted out to her car by the officer around 5am, filed her complaint for false imprisonment and intentional infliction of emotional distress against the store on September 9.

That's more than a fair point, but ultimately those cashiers had no fukkin right to be judge and jury, they're store clerks.
I agree with you wholeheartedly. I am not a fair arbiter here though - I hate Wal-Mart and everything that it stands for. And you left out the Dumass Manager - they all should have to pay a fine for being not only stupid but mean and vicious , as well!

A torn bill can certainly be taped back and re-used, the bank would send it back to the Fed for replacement when it gets there.

No store personnel should be tearing it up. The police can certainly be called.....but they likely know no more about counterfeiting than any layman, they in turn would have to call in some representative of the US Treasury/ BEP to make a determination....that's the way it's supposed to go down, I think.

In reality , I believe most retailers would be willing to give you questionable bill back and allow you to pay some other way to avoid all that stuff....once some manager is called over to the checkstand.

A real bill can fail the pen test, and a counterfeit can pass it. It is a very basic test performed by people with no expertise on currency.

If you get stuck with a fake bill, it is pretty much your loss.

I hate that our society is overly letigious (sp), but this is a valid suit.

Walmart cashiers are certainly no experts. One could have an older big bill from say the 60's or 70's when the Presidential picture wasn't enlarged ( like the current $1 bill)....these Walmart cashiers may never have seen one like that, but they are legal ( and would pass the pen test).

People have won cases like this simply by spending $2 bills. You can have your bank order them for you. They are current currency.

I always ask cashiers at grocery stores or other places when they spend 5 minutes comparing my signature on my ID with my Credit card, if they got their advance training at Quantico or Langley?

it's rare for any place to even bother to check that.

Depending on what sort of mood i'm in and how miserable and rude the clerk is, I will sometimes hold up the four dollar bills she gives me as change to the sky to check they're legit, in the same way she just checked my hundred.

I don't do this so much now but when I do I never utter a word, it's a silent 'fukk you' and words really aren't necessary.

I get why they're doing it with a hundred but it really pisses me off when they do it with 20's, especially if you've just got 300 from the ATM (in 20's) and your bill is 260, it's fukkin ridiculous.

I thought when they thought a bill was conterfeit, that they had to turn them in to the Secret Service. They have no right to rip the bills up.

If you did it by the book, yes that would be proper. I think all you get is a receipt for it and you are out the cash.

In reality, I envision the store returning the bill to the customer ( 99% of the time) explaining it may not be genuine and saying to have your bank check it out....then taking another form of payment or no sale. I think most places would take the easy way out of this.

Here locally, all counterfeit money or bills suspected of being counterfeit are tagged in the SS lock box. If an arrest is being made, the officer must contact the SS before booking into jail. I've never seen or heard of anyone tearing up the money like that. Fuck taping it back together, I'd want two different $100 bills from the register before leaving.
