NEW YORK (AP) - Shares of Papa John's declined on Tuesday following news of class-action certification for a lawsuit that claims the pizza chain had unsolicited text messages sent to cell phones.


THE SPARK: The lawsuit filed with the U.S. District Court for the Western District of Washington in Seattle claims Papa John's violated state and federal law when they had the marketing company OnTime4U send unsolicited text messages on its behalf to cell phones advertising their pizza products. The lawsuit says that 500,000 illegal text messages were sent to Papa John's customers across the U.S.


Papa John's faces potential damages of more than $250 million. The plaintiffs may each potentially receive $500 or more in damages for each text message.


Messages left with Papa John's seeking comment were not immediately returned.


SHARE ACTION: Papa John's International Inc.'s stock fell 34 cents to $49.10 in afternoon trading after dropping as low as $46.72 earlier in the session. Over the past year, the shares have traded in a range of $35.21 to $56.41.

i know the article says that but the damages won't be remotely close to $500 per text. My guess is maybe $5 and only if you fill out the necessary documentation and send it in within a certain time period.

Class action suits are good for two things:

1. They are supposed to curb illegal or unethical behavior of companies (in theory) and

2. The attorneys make a killing on these. A fortune.

Assuming they settle this for something like $75 million, the attorneys will end up getting close to half of that. Then the 500,000 "plaintiffs" (98% of which will have no idea they are even a plaintiff) will end up getting the chance to redeem a Papa Johns coupon in their next order (after they spend $20 or something). It really is usually something crazy like that. And again that's only if the plaintiff actually follow through with the necessary documentation, etc. I'd venture to say well below 20% of the plaintiffs will even ffollow through with it.

It basically works out to the company paying a fine for their illegal behavior and essentially paying off the attorneys on a settlement that will be of close to zero benefit to the actual plaintiffs.

I've been in a few Class action lawsuits over the years... a couple were against Verizon, just this past Aug
But I never sign them...

Even received a check once... something like $1.87 @):mad:

I think the most I was to get from one of these was like $10

all they need to do it a couple of these a year.. $$$$$$$$$$$$

I just got my share of a class action lawsuit against my bank. It was for $6.17. I am also anxiously awaiting my share from the lawsuit against Electronic Arts. This one could be as high as $20.

As per the OP, I received several texts from Papa John's a few years ago. After the 3rd text, I replied "Unsubscribe" and never got one again.

I get a dozens or 2 text messages from BAS and Murphy every day. I am gonna call my lawyer.
