Visitors to Pennsylvania’s busiest casino will tell you that it’s sometimes difficult finding a seat.
But what should be the price paid by that casino for allegedly falling out of one?
A Bucks County jury could be called next month to decide the case brought by a South Philadelphia man who alleges “debilitating” and “traumatic” injuries after falling out of a defective slots chair at Parx Casino in Bensalem.
Tillis Davis and his wife, Denise Daniels, sued Parx Casino, chairmaker Majestic Industries and casino builder TN Ward in county court.
Parx, Majestic and TN Ward each deny any and all allegations of negligence. But Davis’ attorney said the casino has video of the chair coming apart underneath his client.
In court documents, Davis, 56, reported “several and debilitating personal injuries on or about the entire head, neck, back, shoulders, arms, legs, torso and extremities” from the fall.
Davis’ wife also said she has been “deprived of the society, companionship, services and assistance of her husband” because of the incident.
The alleged accident occurred on Christmas Day 2009 and has been winding its way through the courts and arbitration hearings for nearly two years.
This month’s jury trial was requested by Parx after the Bensalem casino rejected a Feb. 12 arbitration award in the amount of $30,000, court records show. Arbitrators ordered the money paid solely by the casino. The case is now listed on civil trial list for May and estimated to last for two to three days. No specific trial date was set.
Davis’ attorney Robert Price said video shows the chair’s back panel coming off and his client falling out.
“They have video of everything, including him falling out of the back of the chair,” Price said.
“A good portion of this will go toward paying my client’s medical bills,” Price added. “He had to go through about three to four months of physical therapy.”
The newspaper was unable to reach attorneys for Majestic Industries for comment after calls and e-mails on Thursday and Friday. Parx attorney Andrew Kramer and TN Ward attorney Susan Lloyd Smith declined comment on the case.
Parx Casino remains one of the top-grossing casinos in the state. The casino saw $280.7 million in revenues from its slots machines between July 2012 and March 2013, state records show. Nearly half those slots revenues — $129 million — went to taxes and fees collected by state, county and Bensalem, according to the Pennsylvania Gaming Control Board.
Sands Casino registered as the second-highest grossing slots parlor in the state with $216 million in revenues during that period, according to the state.
