Has anyone ever sued for medical malpractice?

Hear most lawyers won't take medical malpractice cases unless injuries are clearly visible. Has anyone ever sued for medical malpractice?

What type of injuries are we talking about here.. you have a pretty good case? I assume talking to them directly (a lawyer) would be your best bet.... some of those on tv seem to be pretty confident if you were injured in such n such of ways, they will win every one

I haven't, but I know of someone who did. Dr removed the wrong testicle (cancer), and had to go back in and get the right one. Dude settled for like $80,000 and spent most if not all on drugs.

Yes..the bigger firms will not take them unless they can get big dollars....mine was my wife who during a mastectomy received 3rd degree burns on her side for a malfunction of a piece of equipment....great pain for 60 days and a nasty scar, settled before trial, and since it was not life changing ie losing a limb etc....there was not much there....but did get a settlement.

Basically a psychiatrist "fired" me as a patient when I was going through a rough time. She refused to provide me with medication and did not give me proper notice to find a new doctors. Going to be hard to prove damages but in cases like mine, the current doctor is supposed to treat the patient until a new doctor is located. Some doctors have two to three months waiting lists.

Unless you kill someone, I don't think you are going to have much of a case. Threaten to kill her, then maybe she may move quickly to recommend someone. Also, what damages have you suffered as a result?

I once served on a jury duty for a medical mal practice suit and when the judge gave us jury instuctions he said we could only find guilty if we believe 1 of the following 2 things occurred ...

(1) malicious intent to harm the patient.

(2) gross negligence in not providing care for the patient.

BUT a mistake in diagnosis or a mistake in treatment could not be considered mal practice.
