Speaking of car accidents. I was involved in one on march 12, 2014. I was pulling into my apartment garage, it's located one level below ground. So there is a ramp about 10 feet after your clear the side walk. As I was pulling in someone was exting. So I was aon the right hand side. The sidewalk in essence is a speedbump. Then there is about a 10 ft of a 1.5 ft incline, then a 20 ft strip of a downward ramp. Before I could even descend down the ramp a lady was speeding up the ramp. She crashed right into me. I got out of the car and asked if she was okay, she said yeah. The next thing out of her mouth was " it was both of our fault right?" I said no you were going way too fast. We exchanged information and called triple AAA. An hour after the initial accident occurred she claimed to have a head injury and was taken to the ER. The minute the accident room place I called my insurance comoany and filed a claim. I sent my insurance company photos and told the adjuster that there were two surveillance cameras at the the scene. Later that day he called me and said that he spoke with gieco, the lady's insurance, who said they contacted my leasing office who reviewed the footage. About 5 people who work in the office all came to the conclusion that it was 50/50. Fast forward a week I get a call and email from my insurance company saying there accepting FAULT. I went off. I told them, how do you go from the opposing insurance company saying 50/50 to accepting fault. They told me after reviewing all of the evidence that I was more on her side. I said " did you watch the video?" He said "no". I about lost it. I said you have it on video but yet base your final decision on post accident photos? I


My policy only includes liability, yes I know. I should have had full coverage but I didn't. So not only is my car not going to get fixed but they're trying to put me at fault. It's one thing to take a monetary loss but don't pour salt on my open wound. They also offered he 750 for her head injury and will the ER out of pip. I'm just at a loss of words. I had two spend an hour on the phone with a supervisor explaining all this just for them to reconsider there decision and request a copy of the film. She told me she was unaware that there was a video. I told her the person handling my claim not only knew about it but discussed with the opposing party. The lady by the way just moved into my building and was no taller than 4ft 7. Going up that steep incline is tuff to begin with. Couple that in with. Height disadvantage your looking at a dangerous scenario.


Now the the last part of the story. At the bottom of the ramp there is a garage door, which has been broken 3+ months. If that gate was operational at the time of the accident am pretty sure this would have never too place or at least not to this magnitude. I went to the leasing office and voiced my displeasure and was told that they had to special order special springs. I said from where? The moon? Any legal experts think that they should be accountable at all? I read through the lease and saw nothingi. In regards to garage door. Sorry for the long post, I'm pretty defeated at this point.


By the way, the lady hit me so hard my car won't start. My bumper is on my hood and she smashed my radiator in. The front headlight is smashed and there is body damage to the front panel and driver side door. I told my insurance there is no way that she was going at
A cautionary speed, she would have at least be able to causing so much damage. Like I said, I had t even gone Dow. The ramp Nd just cleared the side walk. I couldn't have been going more than 5mph. Now I no car, no money to get a car or fix it. No one has even assessed the damages of my vehicle but I'm pretty sure it would be deemed totaled according the blue book value. 2005 Chrysler Pacifica. It was paid off, now I'm going to have to a.)Buy a new or used car b.)lease a car. Either way I'm going to paying something monthly.

Letter to the other party


I completed your injury evaluation after we got off the phone and wanted to get an offer out to you. I thought I would email it to you because it sounds like you are busy during business hours.

I have that you hit your head in the collision and sustained a bruise on your forehead. You went to the Emergency room on the date of the accident to make sure you did not have a concussion. I know this accident was upsetting and emotional for you. I am here to compensate you for the injury and pain you had from the accident. We do not know how much the total ER bill will be, but I can set money aside to cover that once we get a bill from them or Geico, if they pay it under your Medical Payments coverage.

My upfront offer to you is $750.00. This is to pay you for the pain and suffering from this accident.

The set-aside will be $2,500. I would anticipate the bill to be less than $1,000, but I always want to put more aside than I think we need. The $2,500 will cover medical treatment received within 30 days of the loss date for injuries sustained in the accident.

If agreed, I will get the payment out to you for $750.00 along with a release agreement for you to sign and send back. My file will remain open pending the ER bill.

This can be a little confusing, so let me know if you have any questions. I am in all day today and tomorrow, but I will be out on Friday.

i haven't even seen the video, the leasing office wouldn't even let me view the footage ,let alone obtain a copy.

so i contacted the regional office. The woman said she would do her best to get me a copy. the leasing told me i needed a court order, subpoena or be requested for a police investigation.

sorry if the initial post was all over the place, I was little emotional. It was all good just a week ago lol.
